Terms of Service

These Terms of Service govern your access to and use of our website, application, and related services.

1. Introduction & Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Brodin Dev, a company registered in Norway under organisation number 973 861 778 ("Brodin Dev", "we", "us", or "our").

These Terms govern your access to and use of all software, features, content, and services made available by Brodin Dev through its web application and associated platforms (collectively, the "Service").

By creating an account, accessing, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.


2. Eligibility

2.1 Age Requirement

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is higher, to use the Service. By agreeing to these Terms, you represent and warrant that you meet this requirement.

We do not knowingly permit individuals below the minimum age to create accounts or use the Service. If we become aware that a User does not meet the eligibility requirements, we reserve the right to immediately suspend or terminate their account without prior notice.

2.2 Global Availability

The Service is available to users worldwide. However, it is your responsibility to ensure that your use of the Service complies with all applicable local laws and regulations in your jurisdiction. Brodin Dev makes no representation that the Service is appropriate or legally available in all locations.

2.3 Capacity to Contract

By accepting these Terms, you represent that you have the full legal capacity to enter into a binding agreement. If you are using the Service on behalf of a legal entity (such as a company or organisation), you represent that you have the authority to bind that entity to these Terms.


3. Accounts & Authentication

3.1 Account Requirement

An account is required to access and use the Service. You may register and authenticate using one of the following methods:

  • Email and password
  • Google (OAuth)
  • GitHub (OAuth)

You agree to provide accurate, current, and complete information during registration and to keep this information up to date at all times.

3.2 Account Security

You are solely responsible for:

  • Maintaining the confidentiality of your login credentials and any access tokens associated with your account;
  • All activity that occurs under your account, whether or not authorised by you;
  • Immediately notifying us at contact@brodin.dev if you suspect any unauthorised access to, or use of, your account.

Brodin Dev will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials. We reserve the right to require you to reset your credentials if we have reason to believe your account has been compromised.

3.3 One Account Per User

Unless expressly agreed otherwise in writing, each individual user is permitted to maintain a single active account. Creating multiple accounts to circumvent restrictions, access free tiers fraudulently, or for any other unauthorised purpose is prohibited.

3.4 Account Accuracy

You agree not to impersonate any other person, use a false identity, or misrepresent your affiliation with any person or entity when creating or maintaining your account.


4. Payments, Subscriptions & Billing

4.1 Merchant of Record

Payment processing for paid plans, subscriptions, and other paid features of the Service is handled by Polar.sh, which acts as the Merchant of Record for those transactions. By making a purchase or subscribing to a paid tier, you acknowledge that your payment transaction is processed by Polar.sh and subject to their applicable terms and payment processing policies.

Brodin Dev is not a payment processor and is not responsible for the technical execution of payment transactions or the security of payment data submitted to Polar.sh.

4.2 Subscription Management

You may view or manage your subscriptions through the billing interface, checkout flow, or account controls we make available. It is your responsibility to manage your subscription status, including upgrades, downgrades, or cancellations, using the tools or instructions provided for the relevant plan.

4.3 Billing Cycles & Renewals

Subscription plans may be billed on a monthly or annual cycle, as specified at the time of purchase. Unless stated otherwise at checkout, subscriptions will automatically renew for a subsequent period of the same duration unless cancelled before the end of the current billing period.

4.4 Refunds

Refund eligibility and processing will be governed by the refund terms applicable at the time of the transaction, including Polar.sh's refund policy where relevant. Brodin Dev may make reasonable efforts to assist with refund requests but does not independently process or guarantee refunds.

4.5 Price Changes

Brodin Dev reserves the right to change subscription pricing at any time. Where a price increase affects your current subscription plan, we will provide you with reasonable advance notice (no less than 30 days) prior to the change taking effect. Your continued use of the Service after the effective date of a price change constitutes acceptance of the new pricing.

4.6 Taxes

Prices displayed may or may not include applicable taxes (such as VAT), as stated at the time of purchase. You are responsible for any taxes, duties, or levies imposed by your jurisdiction in connection with your use of the Service, except to the extent collected and remitted by the Merchant of Record at checkout.


5. Acceptable Use & Prohibited Conduct

5.1 General Standards

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all content, activity, and conduct that occurs under your account.

5.2 Prohibited Activities

You must not, and must not attempt to:

  • Abuse or disrupt the Service: Use the Service in any manner that could overburden, damage, disable, impair, or interfere with the proper functioning of the Service or its underlying infrastructure, including through denial-of-service attacks, automated scraping, or excessive API requests;
  • Reverse engineer: Decompile, disassemble, reverse engineer, or attempt to derive the source code, architecture, or algorithms of the Service or any component thereof, except where expressly permitted by applicable law;
  • Upload malicious content: Submit, upload, transmit, or otherwise introduce any viruses, malware, ransomware, trojans, logic bombs, spyware, or any other harmful or malicious code or content through the Service, including through file upload features;
  • Unauthorised access: Attempt to gain unauthorised access to any portion of the Service, other user accounts, or any connected systems or networks;
  • Intellectual property infringement: Upload, post, or otherwise transmit content that infringes any third party's copyright, trademark, trade secret, patent, or other intellectual property rights;
  • Illegal conduct: Use the Service for any purpose that is illegal under applicable law, including but not limited to fraud, money laundering, or the transmission of illegally obtained information;
  • Harassment or abuse: Use the Service to harass, threaten, defame, or abuse any individual or group;
  • Misrepresentation: Falsely represent your identity, your affiliation with Brodin Dev, or the nature of the Service to third parties.

5.3 Consequences

Any violation of this Section may result in the immediate suspension or permanent termination of your account, at our sole discretion, with or without prior notice. Brodin Dev reserves the right to report illegal conduct to relevant authorities and to cooperate fully with any resulting legal proceedings.


6. Intellectual Property

6.1 Brodin Dev's Rights

All rights, title, and interest in and to the Service, including its software, design, text, graphics, logos, user interface, and underlying technology (collectively, "Brodin Dev IP"), are owned by or licensed to Brodin Dev. These Terms do not grant you any right, title, or interest in the Brodin Dev IP other than a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely in accordance with these Terms.

6.2 Restrictions

You must not copy, reproduce, distribute, sublicense, modify, create derivative works from, publicly display, or commercially exploit any Brodin Dev IP without our prior written consent.

6.3 Feedback

If you provide us with suggestions, feedback, or ideas regarding the Service ("Feedback"), you hereby grant Brodin Dev a perpetual, irrevocable, royalty-free, worldwide licence to use, incorporate, and exploit such Feedback in any manner, without obligation or compensation to you.


7. User Content

7.1 Your Content

The Service may permit you to upload, submit, or otherwise transmit content, including files, profile images, data, and text ("User Content"). You retain ownership of any intellectual property rights you hold in your User Content.

7.2 Licence to Brodin Dev

By submitting User Content through the Service, you grant Brodin Dev a limited, non-exclusive, worldwide, royalty-free licence to store, process, and display such content solely to the extent necessary to provide and operate the Service. This licence terminates when you delete the relevant content or close your account.

7.3 Your Warranties

You represent and warrant that:

  • You have all necessary rights to submit your User Content and to grant the licence above;
  • Your User Content does not violate these Terms, any applicable law, or any third-party rights.

7.4 Content Responsibility

Brodin Dev does not pre-screen User Content and is not responsible for any User Content submitted through the Service. However, we reserve the right (but not the obligation) to review, remove, or refuse to process any User Content that we determine, in our sole discretion, to be in violation of these Terms or otherwise objectionable.


8. Privacy & Data Processing

Brodin Dev collects and processes personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR) as implemented in Norwegian law through the Personal Data Act (Personopplysningsloven).

Our Privacy Policy sets out in detail how we collect, use, store, and protect your personal data, as well as your rights as a data subject. By using the Service, you acknowledge that you have read and understood our Privacy Policy.


9. Service Availability & Modifications

9.1 No Guaranteed Uptime

Brodin Dev will use commercially reasonable efforts to maintain the availability and performance of the Service. However, we do not guarantee that the Service will be available at all times, uninterrupted, or error-free. The Service may be temporarily unavailable due to scheduled maintenance, emergency repairs, or events outside our control.

9.2 Modifications

We reserve the right to modify, update, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify users of material changes in advance, but are under no obligation to do so.

9.3 No Liability for Unavailability

To the fullest extent permitted by applicable law, Brodin Dev shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.


10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

To the fullest extent permitted by applicable Norwegian law, Brodin Dev expressly disclaims all warranties, including but not limited to:

  • Any implied warranty of merchantability or fitness for a particular purpose;
  • Any warranty that the Service will meet your requirements or expectations;
  • Any warranty that the Service will be timely, secure, uninterrupted, or free from errors, bugs, or harmful components;
  • Any warranty regarding the accuracy, reliability, or completeness of any content or data obtained through the Service.

No advice or information, whether oral or written, obtained from Brodin Dev or through the Service shall create any warranty not expressly stated in these Terms.


11. Limitation of Liability

11.1 Exclusion of Consequential Loss

To the fullest extent permitted by applicable law, Brodin Dev, its officers, directors, employees, agents, and licensors shall not be liable for any:

  • Loss of profits, revenue, or anticipated savings;
  • Loss of data or corruption of data;
  • Loss of business or goodwill;
  • Indirect, incidental, special, punitive, or consequential damages;

arising out of or in connection with your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.

11.2 Cap on Liability

To the extent that liability cannot be fully excluded by law, Brodin Dev's total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the total fees paid by you to Brodin Dev in the twelve (12) months immediately preceding the event giving rise to the claim, or NOK 500, whichever is greater.

11.3 Essential Basis

You acknowledge that the limitations of liability set out in this Section reflect a fair allocation of risk and form an essential basis of the agreement between you and Brodin Dev. The Service would not be offered on these terms without such limitations.

11.4 Consumer Rights

Nothing in these Terms is intended to limit or exclude any liability that cannot be excluded under mandatory Norwegian consumer protection law, including the Consumer Contracts Act (Angrerettloven) or the Consumer Purchase Act (Forbrukerkjøpsloven), where applicable.


12. Indemnification

You agree to defend, indemnify, and hold harmless Brodin Dev and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Terms;
  • Your use of the Service in violation of applicable law;
  • Your User Content; or
  • Your infringement of any third-party rights.

13. Suspension & Termination

13.1 Termination by You

You may terminate your agreement with Brodin Dev at any time by permanently deleting your account through the account settings in the Service dashboard. Upon deletion, your right to access the Service will cease. If you have an active paid subscription, account deletion may not automatically cancel that subscription, and you must follow the billing cancellation process made available for that subscription to avoid further charges.

13.2 Suspension or Termination by Brodin Dev

Brodin Dev reserves the right to suspend or permanently terminate your access to the Service, with or without prior notice, if:

  • You violate any provision of these Terms;
  • We are required to do so by law or a competent authority;
  • We detect activity on your account that we reasonably believe constitutes fraud, abuse, or a security threat; or
  • You fail to pay applicable fees when due.

13.3 Effect of Termination

Upon termination of your account for any reason:

  • Your licence to use the Service will immediately cease;
  • We may delete your account data in accordance with our data retention policies, subject to applicable law and our Privacy Policy;
  • Any accrued liabilities or obligations (including unpaid fees) shall survive termination.

13.4 Survival

Sections 6, 10, 11, 12, 14, and any other provisions that by their nature should survive, shall survive termination of these Terms.


14. Governing Law & Dispute Resolution

14.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law principles.

14.2 Jurisdiction

The parties agree to submit to the exclusive jurisdiction of the Norwegian courts, with Tromsø District Court (Troms og Senja tingrett) as the agreed venue at first instance, unless applicable mandatory consumer protection law provides otherwise.

14.3 Consumer Disputes

If you are a consumer resident in Norway or the European Economic Area (EEA), you may also have the right to refer disputes to an alternative dispute resolution body. Information about online dispute resolution is available through the EU ODR Platform at consumer-redress.ec.europa.eu/consumer-redress-landscape_en. Norwegian consumers may also contact the Consumer Authority (Forbrukertilsynet) at www.forbrukertilsynet.no.


15. Changes to These Terms

Brodin Dev reserves the right to amend or update these Terms at any time. When we make material changes, we will notify you by:

  • Sending an email to the address associated with your account; and/or
  • Displaying a prominent notice within the Service.

The updated Terms will include a revised "Last updated" date at the top of this document. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.
